  • Do not report 99401-99404 for counseling provided during a problem-oriented E/M service where counseling dominates the visit and the E/M code is selected based on time; in such cases, the problem-oriented E/M code encompasses the counseling.
  • If performed on the same day as an office visit (E/M) for a problem, modifier 25 should be appended to the E/M code (e.g., 99213-25) to indicate a significant, separately identifiable E/M service, and 99401 would be billed separately for the distinct preventive counseling.
  • These codes are for counseling on specific risk factors, not for a comprehensive preventive medicine E/M visit (99381-99397). They may be reported in conjunction with preventive E/M codes if distinct and significant additional time is spent on counseling/intervention not part of the standard preventive visit.
